NO INDEMNITY, NO RIDE

In agreeing to the terms, conditions and indemnity of this form, I confirm that I understand and appreciate that by adding children, bicycles and a competitive event together and mixing them up there is a chance that my child may crash or have an accident that could result in physical injury as well as damage to property. For example, protective headgear and gloves are designed to absorb damage to protect your child and will need to be replaced after a crash. Life is all about risk and the only thing that we can all do is try to manage the risk. Knowing that cycling is not risk free and could be considered dangerous in the event of a crash or accident and understanding that my child may be injured or that his/her bicycle or other property may become damaged; I confirm that my child(s) participation is my choice and that he/she takes part at my sole and absolute risk. By entering my child(ren) into this event I waive and abandon any or all claim of whatsoever nature that may arise, from such participation, against the organiser and/or any members, agents, representatives or sponsors acting on their behalf or otherwise, whether such a claim arises from the default, negligence or any other act or omission on the part of the people above. I have read the rules and conditions of entry and acknowledge that the event is conducted in terms of the event organisers regulations, which I agree to and abide by and will ensure that my child(ren) are also aware of the rules and regulations and that they too will be encouraged to follow them to the best of their ability. I am also aware that my child might be on the trail on his own during the session, and separated from the group for a short space of time, where accidents can happen. I agree that the rules and regulations will take precedence over my child’s understanding or perception.

For the purposes of this indemnity, except where the context clearly indicates a contrary intention, the singular includes the plural and vice versa, words importing the masculine gender include the other genders and vice versa, the word “person/partdicpant” includes a company, close corporation, and any other juristic person and a partnership and any other

body of persons (whether private, corporate or incorporate).

In agreeing to the terms, conditions and indemnity of this form, I cofirm that I understand and appreciate that by adding adults, children, bicycles and a competitive learning/event together, there is a chance that the participant may crash or have an accident that could result in physical injury as well as damage to property.

From and including the date I join “The Chain Gang” (as a day visitor or member this means the day or days that I rode/attended a session with the club) until and including the date that I resign, or my membership is terminated by “The Chain Gang”, I enter upon the properties owned and or controlled and or used or forming part of “The Chain Gang”, including “the Landowners,” their subsidiaries or associated companies, entirely at my own risk and agree that neither “The

Chain Gang”, its employees, directors, agents, “The Landowners”, their directors, offcers, employees, agents, contractors or sub-contractors shall be held liable for any injury, death, loss or damage sustained by me from howsoever arising whilst I am on their properties, notwithstanding that such injury, death, loss or damage is caused by the negligence and/or

wrongful act or omission of “The Chain Gang”, its employees, directors ,agents, “The Landowners”, their directors, o cers, employees, agents, contractors or sub-contractors.

I indemnify and keep indemni ed (notwithstanding that my activities on the property of “the Landowners,” their subsidiaries or associated companies may have ceased) and hold “The Chain Gang”, its employees, directors, agents, “The Landowners”, their directors, officers, employees, agents, contractors or sub-contractors harmless against all claims which may arise in respect of any loss or damage to any property, all and any claims made by a third party and any death or injury to any person howsoever arising out of my activities on the property used in connection with my membership of “The Chain Gang”, including any consequential damages arising directly or indirectly therefrom.

The participants will wear a helmet at all times whilst riding a bicycle or scooter and while participating in the clinics.

Gloves and Glasses are also designed to protect, these are optional but recommended. Helmet, gloves and glasses might need to be replaced after an accident, depending on the severity of the fall.

The use of facilities and equipment, including rental equipment, and including the ”Landowners” facilities is entirely at my own risk, and “The Chain Gang” and its employees, directors, agents and the “Landowners”, their directors, officers, employees and agents, are not liable for any loss or damage to property, by theft or any other act/omission, whatsoever,

nor injury or death to any person(s) or animal(s) – due to any act/omission, whether caused by “The Chain Gang”, it’s directors, employees, agents, “The Landowners”, their directors, officers, employees, agents, contractors or subcontractors or not.

Parents/guardians/caregivers of any minors who enter the property and or make use of the facilities at “The Chain Gang”, including the properties of the Landowners, hereby indemnify “The Chain Gang”, its directors, employees, agents, “the Landowners”, their directors, officers, employees, agents, contractors or subcontractors against any claim which may arise due to the use of the property/premises/facilities of “The Chain Gang”, including those properties/premises/ facilities of the “Landowners”.

I understand too, that I am liable for all costs, fees and payments due, including legal costs on an attorney and own client basis, collection of commission and tracing fees, if any, incurred by “The Chain Gang”, its directors, employees, agents, “the Landowners,” their subsidiaries or associated companies in taking steps against me to enforce their rights under this indemnity.

The agreement contains all express provisions agreed on by “The Chain Gang”, “the Landowners,” their subsidiaries or associated companies and myself with regard to the subject matter of the indemnity and I waive the right to rely on any alleged express provision not contained in the indemnity.

No variation, novation, abandonment or waiver of rights in terms of this indemnity or consensual cancellations thereof shall be of any force and effect unless reduced to writing and signed by “The Chain Gang”, “the Landowners,” their subsidiaries or associated companies and myself.

I understand that I may cancel at any time and that the amounts payed are not refundable. Life is all about risk and the only thing that I can all do is try to manage the risk. Cycling is not risk free and could be considered dangerous in the event of a crash or accident and understanding that the participant may be injured or that his/her/thier bicycle or other property may become damaged; I con rm that the par(s) participation is my choice and that he/she/they takes part at my sole and absolute risk.

By entering the participant into this event/clinic/activ I waive and abandon any or all claim of whatsoever nature that may arise, from such participation, against the organiser and/or any members, agents, representatives or sponsors acting on their behalf or otherwise, whether such a claim arises from the default, negligence or any other act or omission on the part of the people above.

I agree to be added to the WhatsApp group for the group sessions/extra murals/events for class communication purposes.

I agree that Images may be used for social media/website/marketingx purposes. Should the weather stop a session, depending on the length of time already used, an alternate date might be discussed. (>30mins, no alternate date) (<30 mins, alternate date, no extra cost).

Your time starts when you session is booked for, If you arrive late for the session, unfortunately the session will still end at the original time. If you miss the session, you are liable for payment for the booked time. And will not be refunded, unless death or serious injury has prevented them to do so.

All sessions are payable upfront, in full.

​

Sessions will be cancelled if there are heavy rains or lighting detected within a 18km radius, (lighting app determined) and an alternate session will be offered at no extra cost. Safety of the riders is imperative.

​

I have read the rules and conditions of entry and acknowledge that the event is conducted in terms of the event organisers regulations, which I agree to and abide by and will ensure that the participants are also aware of the rules and regulations and that they too will be encouraged to follow them to the best of their ability.

I agree that the rules and regulations will take precedence over participants understanding or perception and by submitting this form, I have signed the indemnity.
